Architectural Review Board Process
 
The Architectural Review Committee (ARC) has been established by the CWHOA to uphold and enforce the Declaration and By-Laws that provide for architectural consistency in homeowner improvements.
 
All Chestnut Woods Homeowners signed a Declaration of Covenants, Conditions, and Restrictions for Chestnut Woods Subdivision.
 
Articles X and XI outline restrictions and improvements designed to protect property values and ensure architectural consistency in homes and common areas.
 
Increasing home sales (new and existing) has created a need to keep homeowners informed and compliant to avoid disputes among neighbors and complaints related to violation of restriction / improvement guidelines.
 
Declaration of Covenants, Article X states there are use restrictions for the following:
  • Model Homes
  • Accessory Structures (e.g., sheds, tents, barns, garages not built into home, fences, pools, pool houses, patios/decks, pergolas, gazebos, pavilions, playsets, swing sets, trampolines, basket ball courts and/or hoops, fences, landscape/hardscape structures/fixtures, etc. regardless of attachment to the house or ground permanently or temporarily)
  • Maintenance Improvements (Exterior)
  • Outside Storage: Cloths Hanging, Trash Cans
  • Lot Upkeep
  • Nuisances (e.g., outside activities that are noxious, offensive, vehicle repairs, etc.)
  • Lawn Upkeep
  • Failure to Maintain (home, lot, landscape, etc.)
  • Animals (beyond cats, dogs, reasonable household pets)
  • Signs
  • Water Retention Areas (landscaping or grade modifications)
  • Vehicles Parking (commercial vehicles, mobile homes, boats, RVs, trailers)
  • Antennae and Roof Structures
  • Any homeowner that believes neighbors are violating use restrictions may report these violations to the HOA ARC; ARC must follow-up / enforce
Article XI allows HOA ARC the sole right to investigate and approve all exterior appearance included in above list and more (note above list is not exhaustive and intent is to express Boards objective to approve any exterior improvement that impacts architectural consistency and home values.
 
Article XI also allows HOA ARC and board to actually implement an improvement and charge the homeowner if blatant disregard for the declaration and by-laws is apparent and it is in the best interest of all the homeowners to bring the offending homeowner into compliance with the guidelines so that we protect the interest and property values of all homeowners.
 
Given restrictions listed in Article X you should contact HOA ARC to discuss project approvals in advance and avoid disputes with neighbors and violation of use restrictions.  Always consider if your proposed project may negatively impact property values in the opinion of your neighbor or the ARC.  It is worth having a short conversation with your neighbor to gauge receptivity to your project particularly if your project will impact your neighbors (visible structures, noise, grade changes, etc.)
 
Here is a list of the most common HOA ARC requests.  If you are considering any of the following contact HOA ARC for approval:
  • Landscaping Plans (plans that show the house, proposed plantings, plant types (tree names, bushes, flowers, etc.), beds and materials used in the beds (e.g., mulch, rock, etc.)
  • Patios/Decks
  • Sunrooms  / Porch Enclosures
  • Pergolas / Gazebos / Pavilions or similar open structures
  • In-Ground Swiming Pools (above ground pools are absolutely not permitted)
  • Fences (wood, plastic, fiberglass are likely to not be approved, powder coated aluminum common around pools with appropriate landscaping is preferred)
  • Playsets / swing sets(location, materials, and colors will influence approval)
  • Requests that will not be approved:
  • Above ground swimming pools
  • Tool Sheds or shacks including pool houses that are not integrated with the primary house structure and consistent in terms of materials, color, etc.
  • Animal pens or houses
  • Lawn ornaments (e.g., permanent concrete, metal, plastic sculptures, or blow up figures, trampolines visible to neighbors outside approved fence / landscape areas)
  • Landscape mounds that impact drainage or architectural consistency
 
Instructions for HOA Architectural Review
 
1. The Architectural Review Board (ARB) request form must be completed and approved before any work   
     commences on the property or before town building permit is applied for since HOA approval must
     accompany town building permit application.
 
2. The form must be completed in its entirety by the owner of the property. In its
entirety means the following information must be included when applicable:
 
description of proposed property change (construction, landscaping, etc.)
dimensions (height, width, length)
materials to be used (product name, color, etc.)
who’s doing the work (contractor name, self)
provisions to ensure neighbor or community privacy and architectural consistency with neighborhood and community
 
3. A copy of the plat map for the property indicating the location of the change is required (distance from
    lot lines, neighbors driveways, easements, conservation, etc.)
 
4. The Architectural Review Board Request must then be mailed to the

5. The HOA ARB will review the request form and insure that the request has been filled out properly  
    within one week of receipt (excluding holidays).
 
6. Once the HOA ARB reviews the request they will contact the owner if necessary to
    set up an appointment to review the proposal or requesting clarification of information.
 
8. The HOA ARB will then make a approved or denied decision based on the Homeowners’ Association
    Covenants and Restrictions which govern the association.
 
9. Once approved or denied, the HOA ARB will forward the request back to the
    Requestor through written correspondence of the ARB’s decision.
 
10. The entire approval procedure may take between two to three weeks to
      complete, therefore please plan accordingly.
